These Terms of Service ("Terms") govern your access to and use of the StoryBookly website, applications, and services (the "Service"). By accessing or using any part of the Service, you agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions that may apply to specific features or offerings. If you do not agree to these Terms, do not use the Service.
1. Acceptance of Terms
By using our platform, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the platform.
2. Overview of StoryBookly
StoryBookly is an AI-assisted storytelling platform that allows users to create personalized storybooks or comic books. Users can input text prompts, upload images, and generate downloadable illustrated stories. The platform operates on a freemium model, with certain advanced features available via credit-based purchases.
3. Eligibility
You must be at least 13 years old to use the Service. By using the platform, you affirm that you are of legal age and possess the legal authority to enter into these Terms. If you are under the age of 18, you represent that your legal guardian has reviewed and agreed to these Terms.
4. Account Registration and Security
You may be required to create an account using email or third-party authentication services (e.g., Google, Microsoft). You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
5. Prohibited Content and Harmful Use
You may not use the Service to generate, upload, distribute, or promote content that:
- Exploits or harms children in any way
- Involves child sexual abuse material (CSAM)
- Encourages or depicts acts of self-harm, suicide, or eating disorders
- Expresses, incites, or promotes hate based on identity
- Harasses, threatens, or bullies individuals
- Glorifies violence or suffering
- Promotes or engages in scams, fraud, or plagiarism
- Includes disinformation, spam, or inauthentic behavior
- Involves pornographic or sexually explicit material
- Is intended for political campaigning or mass persuasion
We reserve the right to remove any content or suspend accounts that violate these rules.
6. User Content and Responsibility
You retain ownership of any content you submit, generate, or upload to the platform ("User Content"). However, by using the platform, you grant StoryBookly a non-exclusive, worldwide, royalty-free, transferable, sub-licensable license to use, host, copy, display, adapt, modify, distribute, and create derivative works from your User Content for the purposes of providing and improving the Service.
You are solely responsible for your User Content and any consequences of uploading or publishing it. You affirm that:
- You own or have rights to all User Content submitted
- You have obtained consent from any identifiable individuals featured in images or media
- Your content does not infringe any third-party rights, including copyright, privacy, or publicity rights
7. Use of Personal Images
By uploading images to the Service, you grant StoryBookly the right to use, store, process, display, and modify those images to generate AI-enhanced stories. Additionally, you agree that we may use such images in anonymized form for promotional, educational, or internal research purposes.
If you do not want your images used beyond your personal story generation, you must indicate this via written request to hello@storybookly.app.
8. AI Content Generation Disclaimer
The Service uses AI and third-party APIs to generate story text and illustrations. We make no guarantees regarding the accuracy, appropriateness, or quality of AI-generated content. While we strive to filter out inappropriate or harmful outputs, errors may occur.
Users are encouraged to report any problematic outputs. We reserve the right to withhold or refund credit charges for invalid or policy-violating generations.
9. Payments and Credits
Certain features require the purchase of credits. Payments are processed through secure third-party platforms (e.g., Stripe). StoryBookly does not store your payment information.
Credits are non-refundable except in cases of:
- Technical error
- Faulty AI generation due to system failure
- Content blocked under content policy enforcement
Subscription plans may be available and are subject to separate billing terms. Refunds for subscriptions are provided only in accordance with the stated cancellation policy.
10. Printing Services and User Responsibility
StoryBookly offers physical printing services for user-generated storybooks. When you order printed copies, you acknowledge and agree to the following:
10.1. PDF Preview and Approval
- Before printing, you will receive PDF previews of your storybook that show exactly how the final printed product will appear
- You must carefully review all aspects of the PDF preview, including text, images, layout, formatting, and binding
- By proceeding with your order, you confirm that you have thoroughly reviewed and approved the PDF preview
10.2. User Responsibility for Printed Content
- You acknowledge that the PDF preview represents the exact final appearance of your printed storybook
- You accept full responsibility for any errors, typos, formatting issues, or content mistakes in the final printed product
- StoryBookly is not liable for mistakes in printed materials that were present in the approved PDF preview
- No refunds or reprints will be provided for errors that were visible in the PDF preview but not corrected by the user
10.3. Printing Quality and Technical Specifications
- While we strive for high-quality printing, minor variations in color, cutting, or binding may occur
- These variations are within industry standards and do not constitute defects
- Claims for printing defects must be submitted within 14 days of delivery
10.4. Content Compliance
- You certify that your storybook content complies with all applicable laws and regulations
- You are responsible for ensuring you have rights to all images, text, and content in your storybook
- StoryBookly reserves the right to refuse printing orders that violate content policies or legal requirements
11. Right to Deletion and Data Export
Users may request deletion of their account and associated data at any time by contacting hello@storybookly.app. Upon request, we will permanently delete personal data, generated content, and account records, except where retention is required by law (for example, payment transaction records).
12. Intellectual Property Rights
The Service, its codebase, design, branding, and all related intellectual property are owned by StoryBookly and its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the platform.
User-generated stories are owned by the user but may be used by StoryBookly for marketing and demonstration purposes unless an opt-out request is submitted.
13. Platform Availability and Modifications
We reserve the right to modify or discontinue the Service, temporarily or permanently, at any time without notice. We are not liable for any loss or damage resulting from such changes or service interruptions.
14. Termination
We may suspend or terminate your access to the Service for any violation of these Terms, content policy breaches, fraudulent activity, or legal compliance requirements. Upon termination, your rights to use the Service will cease immediately.
15. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
To the fullest extent permitted by law, StoryBookly disclaims all liability for any damages arising from your use of the platform, including but not limited to:
- Loss of profits
- Inaccurate content
- Technical issues or API failures
- Unauthorized access or data breach
16. Indemnification
You agree to indemnify and hold harmless StoryBookly, its affiliates, officers, and team members from any claims, damages, losses, liabilities, or expenses (including legal fees) arising out of your use of the Service or violation of these Terms.
17. Entire Agreement
These Terms constitute the entire agreement between you and StoryBookly regarding the use of the Service and supersede all prior understandings or agreements, written or oral.
